Hi I applied for ESA NOV 2020 for my disabled daughter. She received a letter from UC saying she no longer needs sick notes. To complicate things she was also a Carer. Her UC breakdown recently was
£311.68. Personal All
£416.19. Limited Capability
£727.87. Total
£364.90 Carers All deduction
£382.97. Universal Credit Payment monthly.
She lost the UC and Carers when starting University.
I understood students like Annie could claim ESA even though they get maintenance loan. I am confused as I am told no ESA claim exists only limited capability entitlement for UC purposes. Can I claim ESA on its own? I thought she had to have a claim in before university to qualify. I know there is old style and new style but would she be under old style as claim backdates to 2020. DWP are useless nobody knows anything.

Hi lorrainevb,
Though I don't know your specifics some people in your daughter's situation are advised to claim National Insurance credits only New Style ESA prior to claiming UC. They do this so that they can be awarded LCW or LCWRA before becoming a student as most students are barred from claiming UC. As she claimed in 2020 it would have been New Style ESA.

Does the ESA assessment done in 2020 stand if she just wants to claim ESA now, it is still on the system as live no fit notes required. DWP are telling me itis not a claim for ESA purposes just UC purposes. I was a DWP benefit advisor years ago when you made a claim for Incapacity Benefit and Income Support was the top up. I made a claim for ESA for Annie they said it isn’t. Confused !

Non at present but she is entitled to claim ESA as disabled student if it began before starting uni. She has underlying entitlement I think as it. is on UC breakdown

The only type of ESA she can claim is New Style ESA which is based on her NI contributions.
I suggest you put in a claim.
