MM vs DWP tribunal was created by benconway728`
A few months ago I got a letter saying my case had been reviewed for the law change and there was no change to my award. I submitted a MR providing the DWP with letters from 13 different doctors including psychologists, multiple psychiatrists, multiple GP’s, mental health nurses going back to 2023. The DWP sent me a copy of additional advice they got from my psychiatrist in 2017 saying I was struggling to leave the house due to anxiety and a letter from my GO saying I had been taking time off work and seeing him 3 times a week. The DWP rejected my MR.
Today I had my tribunal and the judge didn’t ask me a single question and the whole thing lasted for less than 5 minutes. The panel were completely satisfied with the evidence I gave them and have overruled the DWP.
Back pay will be going from standard to enhanced for 2 years and 10 months.
If you think the DWP may be wrong then appeal, you have nothing to loose. I believe back pay may be in he region of £4500. Still can’t believe this has actually happened.

Many, many congratulations on your win at the Tribunal. I suspect the Tribunal panel were quite cross at their time being wasted by the DWP, if they didn't ask you any questions. The panel had clearly made their decision after looking at your paperwork. I'm so pleased for you. Please give yourself a huge pat on the back for taking them on and winning!

Hi, congratulations on your win. I am going through the same process but I wasn’t given the option of doing an MR. I have sent in evidence I was seeing professionals along with appointment letters, I have asked for a paper based ruling as my anxiety is through the roof and don’t feel like I could handle dealing with an oral hearing I was just wondering did you do an oral hearing or paper based? Thanks

Hi MickeyM,
You have to ask for a Mandatory Reconsideration - it does normally tell you this on the paperwork you receive, however if you've not had this, or there was a printing error, then maybe you weren't aware of this?
Speaking for myself, I completed a paper based assessment, and I typed it and taped it to the questions section, as writing was way too painful for me, the size of the forms.
