Current wait times for a case remitted for an oral re-hearing?

The Upper Tribunal upheld the Appeal and referred the case back to be decided again by a fresh First-tier Tribunal. (On the 14/02/2025.)

It was on an error of law. [We had gone from zero points to 8 and 10 for daily living and mobility. But the Decision Notice stated that the 10 points were for being unable to leave the house, and the Statement of Reasons said it was because the claimant could only undertake familiar journies unaccompanied -- because they had managed to leave the house (and have a panic attack) unaccompanied some 18months previously. (Whereas they are actually unable to undertake familiar or unfamiliar journies unaccompanied on the majority of days due to crippling anxiety and panic attacks.)]

The request to appeal to the Upper Tribunal was made just over a year after the decision to refuse the request had been made by the First-tier Tribunal judge.

Hi Tony,

Something similar is happening to me - please see the post entitled "confusion over 2 UTT rulings". Mine has been referred back to the first tier, and I am awaiting a repsonse still.
