Mixed-age couple, Housing Benefit and Pension Credit

Hello,

I’ve received great advice from you before and I was wondering if you could advise me again.
My father will start receiving his state pension in April this year, my mother isn’t due her pension until April 2029.

Thanks to your advice, I managed to get a confirmation from my parents’ council that they will be able to carry on with their HB claim, and won’t be switched to UC instead (their award includes the SDP premium).

I believe that they would be eligible for some Pension Credit once my father starts receiving his State Pension, but I was wondering if they would be able to apply for Pension Credit, or would applying for it trigger the switch to Universal Credit? My mother receives Contribution Based ESA (Support Group) and enhanced rates of PIP (both components).

I would be really grateful for any advice, I’ve looked online but I can’t find an answer to that.

Hi Karolina

I am glad that your Council has accepted that a Mixed Aged couple can remain on Legacy Benefits in this case Housing Benefit.
A new Mixed Aged couple cannot start a claim for Pension Credit instead your mother can apply for the Pensioner Premium to be added as an Income Based ESA top up.
I hope the ESA department will comply and not cause problems. It is because the DWP have targets to hit for movement from ESA to UC.

Hi David,

Thank you very much for replying so quickly. That's really useful to know, I didn't know about Pensioner Premium, the way it's all structured is rather complicated. I think we might leave it for now, there will be some new calculations from the council, we'll see how that goes.
