A number of years ago whilst extremely ill and recovering from a near fatal acquired brain injury dwp moved me from Contributory esa to income based. I phone them and asked them to put me back to contributory based. They said moving was required. I hardly could think straight due to how my brain was affected and gave up, now i'm a lot better than then, but i'm reading about income based top ups to old style contribution based esa. I feel a wrong was done to me. I now have to migrate to UC. Is old style contribution based also being migrated? can i argue i was wrongfully moved from contribution based esa to income based? I would like to avoid being migrated to UC fully.

Firstly if the above email relates to you then you need to change your Forum user name for internet security reasons. I expect you are still getting Contributions Based ESA but with an Income Based ESA top up. Do you ever get a P60 from the DWP? Can you phone the ESA department and ask them how much Contributions Based ESA you get and how much Income Based ESA ?
