Attendance allowance claim rejected was created by Chanel
Hi I am wondering if anyone could help me with any experience they have encountered from a rejected attendance allowance application. I completed the online application 6 weeks ago for my mother who has severe depression and anxiety. Both of these conditions have a great impact on her day to day living and she heavily relies on others to oversee her or provide support and or reassurance in a lot of her daily activities. I am certain she firs the criteria for care needs in the day and we got a letter today to say the Attendence Allowance was rejected on the basis “you must have a disability which means you need right throughout the day frequent attention with your bodily functions, or continual supervision to avoid substantial danger to yourself or others”. Am I right in thinking that they don’t consider her disability to a be a disability that impacts her daily living? Has anyone experienced this with regards to mental health issues and what is a good format of mandatory reconsideration as I will be writing one for her because I’m really disappointed that they seemingly don’t understand that she is incapable of doing a lot of daily tasks by herself. Any advice would be appreciated- thanks 🙏

Hi Chanel

Welcome to the forum.

You might want to have a look at the following FAQ which explains where everything is; www.benefitsandwork.co.uk/guides-for-claimants/faq/forum.

I have done a few MR's for AA applicants and only one appeal in the last 15 years which was successful.

You need to emphasise what personal care you give to your mother, and why, the why part is the important part.

Have you checked out B&W guide to claiming AA under the Guides tab above, it has useful tips on how to claim.

You can use a form called CRMR1 to apply for a mandatory reconsideration; www.gov.uk/government/publications/chall...ork-and-pensions-dwp
