I would like to warn everyone migrating from Legacy Benefits to UC particularly those with a LCWRA Element to the UC award. I recently migrated from a Mixed ESA with LCWRA Benefit to UC but shortly after the migrating I moved home but in doing so my disposable Benefit income (not including Rent) fell by 25% for I lost all of my Transitional Protection i.e. the monies which cover the shortfall in Benefit income from the Legacy Benefit. The reason I lost it all was because my new "Social Rent" was an increase on the previous. This increase would historically have been met with an increase in Housing Benefit as am in an LCWRA Group but instead it was fulfilled by a like for like deduction from my Transitional Protection and because my Rent Increase was in excess of my TP Value, I have been left with zero Transitional Protection and only the Basic UC Award (Housing Benefit increase was met however but that is paid direct to Housing Association) therefore as a result of moving home my Net Benefit Award is down 25% as moving home is seen as a "Change of Circumstance" and therefore there is nothing that I can do about it so am being forced to live on 25% less disposable income despite being Disabled.
So for anyone migrating or planning to start the Migration process a word of caution to ensure that if you are planning to move home do so before initiating the UC Migration for your Transitional Protection Value is made up of your Legacy Benefit Award value plus the Housing Benefit Award at the start of the Migration Assessment Period, this value will then be fixed as Total Award Value and will constitute the maximum award available moving forward.
