If Mandatory Reconsideration takes too long can I go to tribunal

Hi,

I am an autistic multiply- neurodivergent woman with a cooccuring serious mental health condition and cancer (in recovery) and have lost my PIP - down from the Daily Living enhanced rate to nothing - a loss of £444 per month. This, along with knock on effects to my council tax reduction and my costings for my care act package of support - a further financial hit basically.

I’ve submitted a Mandatory Reconsideration but have been told it will likely be a good number of months before there is an outcome. I do not wish to wait it out for obvious reasons, so have the following questions.

Is there a time limit by which the DWP need to give an outcome for the Mandatory Reconsideration?

Is the outcome letter the Mandatory Reconsideration Notice?

Is it necessary to have a Mandatory Reconsideration Notice to appeal to the Tribunal?

Could it be disadvantageous to instigate Tribunal Proceedings without said notification?

Hi Camellia

For PIP you are not able to appeal until you have a MR decision letter.

There are certain codes and dates on the letter that you need to quote when you make an appeal.

You could ask your MP to see if they can help you with your MR and get your case moved up the ladder.
