Hi, I transferred to UC LCW from WRAG ESA in January 2024 and told my work advisor at the time I believed I should be on LCWRA. They sent me out a UC50 which I filled in and sent back February 2024 at no point was I asked for fit notes. I finally got my assessment last week after 12 months, I’ve just been notified that I have been awarded LCWRA Thankfully. I’m just wondering if I’ll be entitled to back pay? I was initially getting transitional protection which I know will now stop. Any advice would be appreciated Thankyou

Hi Fiona

As you asked for a new assessment and a UC50 ( now called a WCA50 ) your entitlement to the full LCWRA rate starts from the date you requested the new assessment. So your backpay will commence from that date.
Your Transitional Protection may not stop. Your previous Legacy Benefits amount will have to be re-calculated by the DWP and a new figure generated for your Transitional Element.
If you are responsible for Council Tax I can foresee problems. But I would wait until the DWP has recalculated your Transitional Protection to inform them.
