"the need for the Tribunal to apply the tests set out in the descriptors faithfully"
www.gov.uk/administrative-appeals-tribun...sa-2026-ukut-358-aac In my opinion it would seem to me FTT don't always ask the right question and when they are given a reply they don't probe sufficient into the response which contains the answer. First Tier Tribunal even more overloaded with appeals. Has the quality of the appeal decisions affected claimaints adversely? Highly likely as it's a lengthy wait to get a hearing for then the FTT to get it wrong and then have to appeal to the upper Tribunal.
I'm making the assumption this applies to the DWP too as the claimant would have had no need for Mandatory Consideration nor FTT appeal if the award was marked correctly first time.
These appeals process takes up valuable physical and mental time for claimaints. There has got to be a better way.
