Hi Very Briefly
.Retired on ill health grounds1997
.I was awardered occupational pension
.Also granted IB- which i continue to claim,the rules changed re occ/pen and IB but i continue to recieve full IB because i am covered under transittional regs
.age 59
.I requested state pension forcast - told me I have 44 years NI payments as at April 2010,but will only need 30 to recieve full state pension when current colition Government set retirement age for men.I also recieve DLA C/M
.SORRY FOR THE PRE AMBLE
.My next planned IB Review is 07/12
if my new claim is not successful re IB//ESA? will they give me JSA ??
Thanking you in anticipation
Needless to say this site has helped me greatly with my IB and DLA applications over the years.
I am reluctant to ask DWP for an answer in case they bring forward my review date/more stress.
Can anyone advise Thanks

When your IB next comes up for review in July 2010, you will be migrated to ESA at this date.

If your review is not successful and you are refused ESA, you will be able to appeal the adverse decision and receive payment at the assessment rate, until your appeal is decided. If your appeal fails you will be able to claim JSA, because if you are male, you will not have reached the state retirement pension age. If you are female, different rules may apply as the retirement age is gradually equalised to that of men.

I am sorry that I unable to detect conclusively whether you are male or female from your post, but I hope that this is of some assistance for you?

The current retirement age for men is 65 years of age, and 60 years of age for women. However, over the next 10 years these will gradually be changed and the age for receipt of State Pension will increase

The rules on N.I. contributions changed in 2010, so that now both men and women will only need to have paid 30 years of N.I. contributions ( or N.I. credits) to receive full state pension (SP) on retirement. Prior to this men had to have 44 years of N.I. contributions ( or credits) to qualify for full SP, and women had to have a total 39 years of N.I. contributions ( or credits) to qualify for full SP.

Between 2010 and 2020 women's retirement ages are increasing to 65.

Between 2024 and 2026, retirement ages for men and women are increasing to 66.

Between 2034 and 2036, retirement ages for men and women are increasing to 67.

Between 2044 and 2046, retirement ages for men and women are increasing to 68. More details at State Pension Age Calculator

'We will write to customers when their benefit becomes due for reassessment to tell them about the changes.'

This would suggest that in your case review may not be carried out until July 2012, although the goalpost may well be shifted as time progresses.
