I recently had begun to feel a little better as I was trying out tasks that I could not previously carry out. I then informed the DLA dept. whom then sent me out a form for them to look at my claim again.

I have one month to return the form.

I often had episodes (and also different types of another attack that I suffer with) but for a few weeks, I begun to feel that I may be making a recovery and felt elated that my body at last may have begun to repair itself. (Even though I am still taking lots of prescription drugs that help me get by).

But only yesterday, my neck was locked in a backwards position for a total of between 5 – 5.5hours which is the longest that this type of attack has happened, the previous longest length being 4 hours.

After 1.5 hours, my wife rang an ambulance and the Paramedics said that they had never seen such an episode before and took me to Hospital where this attack was witnessed by the Doctor assigned to me. He gave me muscle relaxants by mouth and when he saw that these were not working, he then gave me muscle relaxants intravenously and I had to wait for them to work fully. In the meantime, I was in extreme pain.

I have had a different type of attack video recorded and in the presence of a Neurologist whilst in Hospital in order to rule out epilepsy, so the Hospital also has video evidence of one of the types of episode that I suffer from. I have lots of home-made videos of a lot of episodes.

In the light of this, I don’t know how to proceed with the ‘looking at your claim form again’. I certainly could not go through all the stress that I went through trying to get this benefit and would welcome any suggestions that can help me.

I do now realise, that I was too optimistic about my health, which again, does not help me keep a positive view of myself and my long term health and the pain that I go through.

I receive DLA because of these attacks and had to go to a Tribunal in order to fight the original decision to refuse me DLA initially. It was only because of the correct guidance from this site that I was able to win my case. (Thanks again for the help) With my current setback in my health and if I now lose DLA and am told that I will have to go to work; which I know that I can’t – despite having a good try, I know for a certainty that it will cause an amount of pressure on me that I would not post here what it may well lead to.

Hi Linsky,

It's a real shame the improvements in your condition didn't last.

You could contact Blackpool, tell them what has happened and say you want to withdraw your request to have your award looked at again.

But I'm afraid that if they insist that the form must now be completed I don't know if it will be possible to avoid doing so.

If that is the case you will need to just give the most accurate picture you can of how your condition affects you, including evidence of your most recent visit to hospital, if possible.

Thanks for the advice Steve, I have already set the wheels in motion to get the Hospital and Ambulance report in order to send with a letter to the DLA office in the hope that they will not insist that I go through the whole form filling processes again.

I will post the outcome on here as soon as I have it.
