ESA Tribunal>>>>>failed was created by SIG
Just been to Esa tribunal..and, suprise suprise...my appeal failed....not enough medical evidence!!!!...this after Note from GP backing up my medical conditions, actual scan reports and consultant letter..
People say they are fair and independant....like hell...
The chair repeatidly asked the same question over and over....and...when i answered moved the goal post with another question, there was no way i could win...and, the iceing on the cake was when he accused me of trying to score points (isnt that what its all about!!)...when i corrected him when i said i leaned against a wall...he said i balanced....i said...you dont balance agaianst a wall....might as well walked out then.....he didnt like that one bit...so...i am now stuck with either making another claim...or getting nothing......this system is so unfair.....be warned

I'm sorry your tribunal went against you. I can't imagine what more in the way of evidence they can want than a GP, a consultant and scan reports.

Hi SIG

Your hearing sounds a bit like mine. I lost interest five minutes into the hearing when I realised from the attitude of the judge that the appeal would not go my way, and I was already thinking of an Upper Tribunal appeal. I even asked the judge if I have time to pop out for a cigarette when asked to leave the room so they can consider their decision, as I knew their decision was already made.

I would advise you to apply for a full statement of reasons from Tribunals Service. It should explain why they rejected all the medical evidence you provided, and if they fail to do this, you could have grounds for an Upper Tribunal appeal.

You have a month from the tribunal's decision to apply and on receiving it, there is no obligation to take the appeal further if you don't want to.

Hi Sig

Im sorry to hear your news, I must admit, its depressing to continually hear such events , not just on the forum, but also the progaganda spread by the papers , along with the same news of other through other sources suffering this same fate - May I ask your condition ?, as in particular those with mental illnesses seem to be suffering more then Most.

The same thing happened to me sig, i later found out the Doctor on the appeal panel worked in private health, so what does that tell you..!!
They are not impartial, it's just not true, and it's going to get even worse because this Government are on a crusade against the disabled and ill.
If your condition has worsened, then you can re-apply like i did and just start again.
Sorry i dont have anything positive to say sig, but we are all learning the hard way, when it happened to me thats when i finally got the message and realised what a scam it all is..!!

I have sent of for the full statement of reasons, so, will see what turns up!!!
Wether or not to go through the whole dis-heartening episode again, im not sure....
