DLA Appeal question. was created by Callisto
Hi Folks
Am now going through all the info on this site connecting to my DLA appeal. What worried me was the bit about the status of the Doctors sitting on the panel. It mentions that they may well be the ones that carry out the medicals for the DWP. I dont think i would stand much chance if i was to be confronted by the EMP that conducted my home visit! He stated emphatically that he did not accept M E even though i do have other conditions as well.
What do you think about the likelyhood of this. Bit concerned of this point.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Louisa,
It won't happen. You will be given the name of the doctor on the panel when you get your tribunal date and if it is a doctor you have had any connection with you inform the Tribunals service and they will substitute with a different doctor.
It is against the rules - and would be a breach of natural justice - for the doctor who did your medical to be on the tribunal panel.
Good luck,
Steve

Thankyou Steve, i am reassured by this. I could not find any reference to the doctor on the papers they sent me but they might still send me something else. I could not imagine they would do this.
Thankyou
Louisa
