Hi,
I have Angina, severe Asthma, M.E ( possible M.S ) I.B.S and also suffer from Anxiety/depression. Thanks to this site I got a five year award for my D.L.A. I get high care/mobility and also S.D.A. I am exempt from the all work test, does this still stand? I received a letter over a year ago which stated they no longer required me to send in any more sick notes. Will this also change? With the new medicals coming in to force will this mean that my 5 year D.L.A award will be cancelled? Will I be able to request a home medical as I get very bad nights due illness. I have contacted my local council but I was informed that the welfare rights officer there is not able to take on any more cases so who could represent me? as I will just fall apart once someone starts firing questions at me. thanks

I also forgot to add that due to ill health, I had only ever been able to work part time before getting too ill to work at all. I was not able to claim job seekers allowance or dole as it were called back in the day, when I was in between jobs because I was told at the time I had not paid in enough of contributions. So I was just curious as to what happens to people like myself when they decide we are fit to work. No income at all until we appeal? thanks

You are writing inn anticipation of a medicasl in the future. Under Incapacity as it stands you are unlikely to have a medical before transfer to the new system of ESA. The new system for people transferred to ESA (except in pilot areas this does not begin until next year) will be the ESA medical . Under that system your exemption from the Incapacity system medical wont apply to ESA. You may or may not require a fresh medical when the time comes, it is hard to say, and in part depends on the paperwork held on you and what you eventually write when in the future they send you forms.
The ESA will not of itself affect your DLA
though it is possible that ESA Medical examination results CAN be used on occasion to review an award of DLA
You can request a home visit when your next medical is required but ATOS will look for medical evidence to justify this
Seek advice from the CAB if the local welfare rights service cannot help
You are an exempt case for IB and those exempt customers being moved to ESA, no one knows when they will be moved,. If you were a non exempt case, it would be your 'review date' on your IB file that would trigger your migration to ESA
