ESA medical success but what about IB appeal was created by keddi
Had some good news today after I was expecting the worst. I passed the ESA medical and am now in the Work Related Activity Group. Much thanks must go to this website for the information that helped me prepare.
I only went onto ESA as I failed the Incapacity Benefit medical back in April. I am appealing this and should see a tribunal sometime after December. My dilemma now is if I am successful at the tribunal, should I go back to IB or should I stay on ESA, or will this happen automatically?
Anyone have any thoughts on what is the best situation to be in?

Very well done.
I think the rates for ESA(WRAG) and long term IB are the same at £91.40, so unless there is another benefit affected by the choice, I suspect they might try and keep you on ESA. The benefit of staying on IB is that you might avoid another medical until you are "officially" transferred to ESA.

some IB claimants qaulify for the age related condition. Cannot remember the detail right If that were the case then IB would be the best

mmm - I have to decide whether to go through the stress of going in front of the tribunal for IB. I would benefit from a back-dated payment of about 3 months of IB (the difference between what I was getting on ESA and the full rate). I don't suppose if the IB tribunal went against me it would affect my ESA.

It depends on the prognosis set by the doctor at the medical. The Decision maker often sets a date for the next 'assessment ' process and usually bases it on the doctors prognosis advice ..
prognosis means the outlook for your condition, will it be stable, get better etc etc
Usually people are told of a date when the next forms will be sent to them. That information is in the letter after you have succeeded with an assessment, whether or not you had a medical or if they decided you qaulify on the paperwork alone

Can I ask why you claimed ESA as opposed to reduced rate Income Support (if you met the conditions of entitlement) or JSA, as you may have been entitled to do following the appeal against the termination of your Incapacity Benefit entitlement?
