When was your medical?

You say you are on ESA, but you scored 0 points, have you appealed the decision?

Have you looked at the ESA documentation in the Members area, this explains the WCA tests, there is also a quick WCA test, which would give you an idea of how many points you think you should have scored.

OK, the first thing you need to do is get some help from somone who can sit down with you and go through all of your information. Your local CAB or a Welfare Rights Officer would be good choices.

Given that you are already appealing your options appear to be limited. Unless you can show a significant deterioration in your condition or a new condition that prevent you from working, you cannot make fresh appeal for ESA.

The Decision Maker would have carried out a reconsideration of the evidence as part of the appeal process, however, if you have additional evidence you can submit for a further reconsideration. Please bear in mind that all evidence you submit must be relevant to the date of the medical, any evidence that relates to your condition since that time will be ignored.

The best advice is for you to concentrate on preparing for your appeal. Whilst a Tribunal is inquisitive rather than evidencial, if you can collect evidence to support your clain you most certainly should. You should also go through the ESA documentation in Members area to support your contention that you should have been awarded 15 points.

If you have other questions, please come back to the forum.
