Why a second ESA50 form?

Why a second ESA50 form? was created by Pumpkin
Hello. This is my first post so please forgive me if I'm a little unfamiliar with the system.

First, the good news: in August my son was granted ESA on appeal, going from 0 to 15 points, for which grateful thanks to BW and Citizens' Advice.

His increase in benefit was backdated to June 2009 when he originally applied.

He has now received another form ESA50 from Atos without explanation. He was not previously claiming IB so it is not part of the switch.

Can anyone tell me why this second form is necessary, and whether he will need to to provide medical evidence all over again?

The appeal, and the award at appeal, will relate to the original claim. Being awarded ESA on appeal does not stop the claim being reviewed, even if that means being reviewed just after the appeal.

To judge by what people are posting on here and elsewhere, this seems to be happening quite a lot.

Does this mean we are back to square one? How regularly can DWP review cases?

They can review them quite frequently. Some people find their cases being reviewed every three months.

Hello Pumpkin

I have just had a second medical for ESA and my appeal against the first decision has still not been heard. I got my ESA50 in october and my original application was september 2009.

I questioned it the same as you but unfortunately this is just how it seems to be and I am expecting one every year. Hopefully this time the result may be better for me fingers crossed but it does seem to me to be a crazy system considering I have not even had the appeal to my first decision yet.....they are just chasing their own backsides...

Hopefully with the information you have from here you will be able to give a more informed account to the DWP and help the situation go more smoothly than before. My second ESA50 was far more detailed than my first and further medical evidence included has also helped that i did not use first time around.

Where do you live ? If its one of the test areas you could now be being contacted to move from IB to ESA by mistake or they could as is often seen being poor losers :(
