SDA advice please was created by Fleur33
Hi, I have been receiving SDA now for many years. How will these new changes affect this type of benefit? I have read that all the incapacity benefits will be checked first, does this mean my benefit will not change yet? Thanks

Nothing on this board constitutes legal advice - always consult a professional about specific problems

We cab only guess at when you might be transferred, Several other sites are saying that SDA claimants will be transferred lst, which would probably be 2014.
However, we have also heard that anybody who is PCA exempt, as a lot of SDA claimants appear to be, will be transfered in the first year.
I think the best advice we can give is to read the ESA guides in the Members area to familiarise yourself with the process, and think about what evidence you would need to collect when you are transferred.

Replied by Fleur33 on topic Not paid enough contributions
Hi, I forgot to add that I had not paid in enough of contributions in order to claim incapacity benefit when I became too ill to work, as I had only ever been able to work part time (I claim DLA and SDA )Now with these new changes what benefit will I be able to claim? or what group will I be placed in? I am so worried about all this that when I visited my GP yesterday, I was rushed to Hospital, due to my heart problem. There was a time when people retired due to having heart problems, now it seems you are fit to work!

You will be transferred to ESA, but whether this is Conbtribution Based or Income Related will depend on how the DWP see your previous NI contributions.
As to what group you might be put in, this will obviously depend on how well you meet the test requirements for the WRAG, or the criteria for the SUpport Group. You can read about both of these in the Understanding ESA guide in the Members area.

Thanks for your reply Gorden,
What is this P C A exemption you mention? I was told I did not need to send any more sick notes in, around a year or so ago and I was exempt from the all work test.Does that mean anything to you regarding P C A ?
Thanks

I have also read that as my partner is in full time work, I will not be able to claim ESA. Surely that can't be right, if I was able to claim SDA while my partner was in full time work? I will not have paid any contributions in, because I was only ever well enough to work part time.
