Hi Tim, I had to appeal last year and the tribunal awarded me 6 months. It was all very stressful and I have now received the papers to re-apply as the 6 months will finish in March. I was wondering the same as you re what do they take into account. It all seems another nightmare is about to begin.

At least you have the info here to help you.If your circumstances haven't changed ask why there needs to be a new medical so soon.
Take care

Nothing on this board constitutes legal advice - always consult a professional about specific problems

You don't say what the benefit is, but I assume from your comments it is ESA
I am afraid that most ESA claimants should expect to be re-assessed every 6-12 months.
You cannot assume that your previous history will be reviewed, so you should present a full report every time.
As I understand the Decision Maker will have access to all of your records, the ATOS HCP does not.

The guidelines for Atos Health Care Practitioners, states 'your opinion on when a return to work could be considered must be fully and comprehensively justified'.
Gordon. How on earth can they be expected to carry out proper assessments and make recommendations about a possible return to work without access to your medical file?
I am sure i also read something to the effect that it is only claimants with conditions that have a good chance of being short-term that should be given a short review date.
I went from a three year IB exemption to being reviewed again in six months. I was told that this was normal and people with my sort of conditions recover with counselling. (I am not having any counselling and have complex longterm conditions!)
I don't know how we are supposed to have a quality of life with our lives under so much scrutiny. It really amounts to harassment and can only lead to a deterioration in our health.

The simple answer is that whilst the system works well for the majority of claimants, for a significant minority it fails miserably and it is only going to get worse.

Based on my own experience, how is anybody supposed to make an informed decision about your health in a 20 minute, spot inspection, when they have no prior experience of treating your condition, fail to apply the tests correctly and make erroneous assumptions on your condition, that results in them missing some of the tests completely?Gordon. How on earth can they be expected to carry out proper assessments and make recommendations about a possible return to work without access to your medical file?
