Hi Survivor,
that is the main problem trying to get through to make an appointment with a CAB advisor,several telephone calls, left messages no response , will have to try and go down there on Wednesday and hope I can just drop in ( wishful thinking for an appointment there and then )not likely. Cutting the time limit tight to appeal that's if I have a case to do so. :unsure:

It's a long-shot but have you looked to see whether there are any solicitors locally that do benefits work?

Hi Survivor,
call back from the CAB this morning apparently the problem is beyond the scope of a generalist advisor and due to my wife working we are above the wage bracket for assistance from a specialist advisor.
In the event there would be great financial compensation involved in pursuing the case it would be beneficial to continue however, it has always been a matter of principle and we simply cannot afford to pay for professional assistance or a professional advocate at Upper Tribunal.
There is simply no other local advice services so it looks like this one is lost however, my conscious is clear for my family and I know I met ESA support group descriptors for mobility and sitting for the period August-December 2010.
Thank You for all the support and help unfortunately seem to have run into a brick wall on this one.

If you are still a member of a trade union
or profesional organisation they may be able to provide legal advice/representation. Also check your home insurance policy to see if you have legal cover & as a last resort think about approaching a 'no win - no fee' law firm.

Can I just raise a note of caution with regard to using representatives who are not familiar with the benefits system, which has its own peculiarities and procedures.

You may end up paying good money for someone who ends up adding no extra value to your claim.

Hi All,
a long shot but I commence residential training on the 15/8 apparently the college has qualified benefit and employment advisor's amongst it's staff, I will take all relevant paperwork with me and see if anyone is willing to offer advice as to whether there is indeed a point of law on which to appeal.
Appeal has to be lodged by the 25/8 so even though time is tight one hopes there may still be possibilities.
