Half Pay was created by cmarie510
Hello again Everyone,
Sorry for more and more questions...anyhow, I have just read another thread re ESA. I have just had to re-apply for due to conflicting advise from the benefits help line.
I re-applied yesterday and the woman who took my details backdated to when my half pay ended which was the end of this feb. This amount was 187.90. I have just read that I could have applied for it during the entire period of half pay (SSP finished 6 mos. prior)
Should she have instead back dated it as much as possible?? If yes, what can I do about it now that my telephone interview is over?
Thank you very much for your help.

I have checked several sources and they all say that the maximum that you can backdate an ESA claim is 3 months, there appear to be no exceptions to this rule.

There is one possible way of dealing with the period before three months ago. If you lost out because you received incorrect advice from the DWP, you can seek compensation from the DWP. A welfare rights adviser should be able to help you put in a claim.

It's not as awful as it seems, it's large font with lots of spaces and there's a contents page so you can skip stuff and just read the bits you want to, but it explains a bit about maladministration, which is what you'd be claiming for.
