hi hope someone can help? ive recieved my appeal date hearing however i have 2 go in 2 hospital a week before 4 an operation. im not going 2 be able 2 attend. i have written 2 jobcentre and told them this. will they do the appeal without me or would i get a later date? thanxs

You can ask the tribunal if it is prepared to defer the hearing. However, do bear in mind that you may find yourself at the back of the queue, as it were, with a long wait until your rescheduled hearing.

Hi Nicky

Once your case has passed to appeal, you need to correspond with Tribunals Service, not the Jobcentre. They should pass on your letter to TS but it is much saver to contact TS directly, as Survivor said.

Thanks for clarifying that, Derek, I forgot to make it clear when saying asking the tribunal that it should be done directly.

thanxs. i have written to the jobcentre and the tribunal enclosing letters confirmin i have jst had an op. i havent heard frm anyone. if i dont go will the case be heard without me or will it be moved 2 another date as i dont think i can make it as jst had bowel suregy. thanxs

Hi Nicky

They should definitely adjourn the hearing to a later date but the decision is with the Judge and you can never be certain.

If you have not had a response from Tribunals Service I think you should phone and confirm that they have received your letter and explain that you cannot attend and wish to have the hearing adjourned.
