Still No News! was created by Tracy A
After three weeks since appeal was found in my partners favour we still have not heard anything despite faxing over the appeal decisions paperwork to both the ESA & DLA.
My partner has just phoned both depts and asked how things were coming along.
Dla said they had sent out a letter last week asking if my partner had been in hosp or care home etc...We've had no letter yet so still waiting for that to arrive...
Esa said that they had the paperwork but they don't even consider looking at the case until after 6 weeks after tribuneral decision?!?! asked why they said it's standard practice?
We asked why they haven't made his payments up to the correct amounts now on his benefits as he is moving to support group, they said WRAG on DLA decision it stated Support group. They said that will also be looked at after 6 weeks!
Does anyone know if this is correct, just seems like they are dragging it out again....
Getting really sick and tired of this now, guess after 6 weeks the ESA will consider sending out the same letter the DLA has said they have sent out..So ok it takes 3 weeks for DLA to do this but not ESA!!
Grrrrrr!!

Whether this will make any difference or not I don't know, but I found the following that may be of interest.

Hope this is of help.Extract from the DWP Code of Appeals Procedure Guide. Hearing and post-hearing procedures
Implementation of First-tier Tribunal’s decision
6550 When the FtT’s decision has been received, it must be date stamped. The decision should then be put into effect as soon as possible...

Gordon, Thank you for your reply. I will ring them and quote that paragraph and see what other rubbish excuse they come up with.
I know it'll take time to sort out arrears payments, but there is no reason for the ESA to not start paying the full amount of Esa rather than the basic rate whilst waiting for an appeal.
I'm not going to roll over on this...
Will post back how I get on.
Tracy.
