National Insurance Contributions and ESA

I would like to think it unlikely, that my husband be declared fit for work - he has been told, that his Physio (though he cant attend due to his blackouts - he gets home aids from them etc), Rhumo consultant, specialist Nurse and his GP have all said due to his many health probs is most def NOT fit for work - ATOS will say he is (he's in bed at the moment in chronic pain).

One question has come up concerning this 'Fit for Work' ruling - he has been told that if they put him in a certain grp, after one year his benefits will cease due to non payment of National Insurance - problem, he gets a pension (Civil Service) on which NI is applied, how would it work for him, obviously we will appeal if he is not put into the support grp, he actually fits into 4 of the WHO Illness groups, but that wont worry ATOS/DWP will it? :S

The Welfare Reform Bill, which is not yet law, but is likely to be passed before the end of the year, will restrict the payment of Contribution Based ESA to one year for members of the Work Related Activity Group, but not the Support Group, from April 2011.

After the year, claimants will be eligible to receive Income Related ESA, subject to a means test of income and assets.

You mention him appealing for the Support Group, the WHO illness groups are not relevant to this, he needs to meet one or more of the Support Group criteria. These are listed in the ESA guides in the Members area.

Daft question, hubby is asleep at moment, how do I get to the members area pls and which guide should I be looking at, if there are more tahn one there?

Click on the "Help for Claimants" link in the orange box on the left of the page.

On the next page, scroll down to "Employment & Support claims and appeals" and select this link.

All of the ESA guides are avaiable here, the Understanding ESA guide is probably the easiest for the SG criteria as they are all listed in one place, see page 24.
