medical evidence for ib/esa appeal was created by craft
please,i failed my ib medical,i am appealing,i sent 2 scans print outs, with my esa50,one scan was 2yrs old for oa of my knee & the other one was 3 months old,for my back the atos doctor took no notice of the print outs & made up his mind putting on medcial false minor disabilities that i have,i have made a complaint about the atos doctor, got phone call for DWP decision maker saying they are sending my papers to the appeal people & he said the appeal will not take notice of medical letters more than 3 months old, i have a letter which is over a year old from a consultant orthopaedic surgeon discharging me saying that the only thing for my knee will be a replacement knee which i am adamant of having done, seeing i dont want a knee replacement i cant asked my gp for to see surgeon it would be a waste of time so i would not get upto date letter.

A couple of points - for IB/ESA, it's not the diagnosis that matters, but what you can/can't do.
Why not discuss this with your GP? If he doesn't think a further referral to a surgeon is appropriate, maybe he'd write something for you confirming that there has been no improvement in the functionality of your knee, or maybe he could refer you to a physiotherapy team that could assess you and do a report back to him, then you could ask for a copy of that.
However, it's not for the DWP to decide what evidence you can submit to the tribunal and if you have evidence of a degenerative condition that is not likely to improve, you can send that in so that the tribunal can consider it if it wishes to. I'd urge you to see your GP as well, but any evidence is better than none.
