Apologies for delay had to go offline. "If the claimant gets their application form elsewhere (for example an advice agency) it will not be date stamped, so the date of the claim will be the date it reaches the DWP"

So if the form you completed was not from the DWP it is the date they received it. If it was from the DWP the date they sent it will be on it and that date will apply.

renewal form came from DWP in feb 11, wasn't dated, just said that current award expires 04/08/11 and to return the as soon as possible. But it took that long to get all the supporting evidence together it wasn't returned till June 11.

So I take it from what you have said the new increased awards or not date dated

The DLA Unit will only normally pay the increased rate on renewal, in this case the HRM component, from the date the previous award expired. A claimant can ask for the award to be backdated to the date of the renewal claim (a reconsideration), but there is a tricky caveat as explained HERE.

In the circumstances, it would be up to your wife to decide whether to proceed with the backdating of the mobility component in view of the warning?

Thanks for the info CD, thats cleared that up, will let sleeping dogs lie.

Does the 4 weeks in arrears period start from the date of last layment or the new award date?

The old award ran out 04/08/11 and the new starts 05/08/11.

We were paid the last 4 week payment of LRC on 02/08/11, but then they paid one week of LRC on 09/08/11?

What date should they start paying the new award of HRM & LRC from?

As the DLA pay week normally runs from a Wednesday to a Tuesday, the payment of the new award should commence from Wednesday 10 August 2011.
