ESA Appeal and GL24 form

Had my ESA assessment medical to see if I could migrate from incapacity benefit to esa. Then had to wait 6 weeks later to be informed by phone from dwp that I scored zero points. They phoned me on the 8th August.

Then dwp person told me my last payment for IB wil end on 30th August 2011 and that I should now make claim for jobseekers allowance. At the same time they asked if I could get sick note from my GP and letter/statement from my hospital consultant to which I replied yes. Told them I wished to appeal against decision.

Got the letter/medical report form by post on 10th August. A joke to say the least!!

Anyway got GP sick note just waiting for document from hospital consultant.

Do I need to contact same dwp office that contacted me by phone to tell them I wish to claim ESA phased assessment benefit as I am appealing the decision.

Should I enclose the gp sick note with the gl24 form now and send without the document from doctor at hospital of which I have no idea when it will arrive.

I am very sorry for such a long query but this whole esa thing is giving me sleepless nights and compounding my severe depressive disorder and anxiety.

The first thing you need to do is return the GL24 Appeal form, to make sure that your appeal request is official. If you have a look at the ESA Appeals guide in the Members Only section, it will explain how to complete this form, this includes documenting the fact that you want to receive the Assessment rate while while you wait for a hearing.

Depending on why you failed to score points, and any fresh evidence you can provide, it may be possible to overturn this Decision by a Reconsideration, so don't assume your only option is to wait for a hearing.

I can't see any reason why you can't include your latest Fit note with the GL24 as they both need to be sent to your local DWLP office, but remember to take copies of everything before you send it, and to send your letters Recorded Delivery.

If you can, try and get advice from your local CAB or Welfare Rights office as they may be able to help you with your appeal submission.

When you appeal your adverse ESA decision, make it known on the form GL24 that you wish to be paid at the assessment rate, pending the outcome of the appeal. It may be worthwhile to note in red on the GL24 in a prominent position, that you want to be paid at the assessment rate. It shouldn't be necessary but you are dealing with the DWP!

You can send the medical certificate with the GL24, but take a copy first as it has been known for the DWP to claim that they have not received it, or it has been lost in transit

Thank you for your response and advice to my query.

I'm going to try local cab office for guidance hoping they are not too overwhelmed from clients who need help with ESA Appeal matters.

Does termination of Incapacity Benefit also mean complete loss of my allied disability premium payment as well? Does ESA assessment rate benefit preclude disability premiums?

Hi,

It depends what the premiums are for, e.g. some premiums are paid due to an award of DLA care component.

Do you know why your premiums are paid?.

Hi,

It depends what the premiums are for, e.g. some premiums are paid due to an award of DLA care component.

Also have a look at page 43 of the Employment and Support Handbook, under DWP Resources, in the "MEMBERS ONLY" orange area on the left.

Rates of pay for ESA are listed there, and any premiums.
