Hi again G,

If you are now in receipt of Contributry IB, and you are awarded ESA, either WRAG, or Support Group, you will then receive Contributry ESA.

In that case there is no Means Test.

However, legislation is likely to be passed in the near future, that means that as from April 2012, anyone in receipt of Con/ESA, will only be entitled to Con/ESA for 365 days, after this the claimant would have to face a means test to see whether they were entitled to Income Related ESA, (Means Tested).

This 365 day entitlement will be enforced retrospectively, i.e., any one who is already in receipt of Con/ESA before April 2012, will lose that period of receipt from the 365 day entitlement.

e.g. If someone was awarded Con/ESA in September 2011, and the Law comes into force in April 2012, that claimant would only have around 6 months entitlement to Con/ESA left in April 2012.

As I have said this legislation has not been passed yet though.

Also if you are awarded ESA, you will have transistional protection, where your current rate of sickness benefit will remain the same.

I should add, that if you are put into, and stay in the Support Group, there is no 365 day limit to entitlement, and you will not be means tested whilst in the Support group.

DLA is not counted in any form of means test, so does not count as income.
