Hi bro58,

I think you are right.

I have contacted my MP, as his strong letter of support was one of the letters reurned as "not required".

I am used to batlles with the DWP, but this is the first ATOS encounter, so to speak.

This could get interesting.

Sorry if this seems like we're ganging up on you :)

You really need to contact your local DWP office to find out why your evidence was returned and if they retained a copy.

You don't want to fail the ESA medical because of lack of evidence and have to sort the situation out at appeal.

At my last IB review when I was sent an IB50 (despite being exempt previously!), the letter from Atos specifically stated not to enclose additional medical evidence etc, but to send it to JCPlus. I queried this along with other matters through my MP as i couldn't understand why they were excluding important evidence especially as decision-makers have been pretty much just rubber-stamping what Atos churn out.

I understand from mods that with ESA it is just GP sick-notes you separate out and send to JCPlus which makes sense.

Selby - I would definitely want to know why they have returned your documents.

Best wishes

Thanks to everyone for their advice and comments.

:)

I am obviously not happy, so have instigated checks on why they have done this.

The main concern is stating that they do not need to consider my GPs extra evidence submitted.

I will let you know what the outcome of all this is.

Well, it seems that I need not have worried unduly over the return of the supporting evidence.

I have been placed in the Support group without a medical.

:)

To say I was surprised would be an understatement!

As others have said, I received a brown envelope, whereas I was expecting a white one, so I wasn't too bothered when I opened it.

It just stated I had been migrated to ESA.
I had to read down almost to the bottom of the first page ( of 6) before I saw Support Group.

I would like to add my thanks to others about the help from being a member of B&W.
The guides are extremely helpful, and made the nightmare of form completion a lot easier.
I am now requesting the ESA85a, to see how long until the next proposed review.

For the moment I can relax, and cope with just being ill!!
