I rang Jobcentreplus today about my claim and was told I am in the WRAG group when I ask why this was. I was told "we are not medically trained and we can't tell you" I’am appealing the decision and asked for the relevant form.

Hi col,

The DWP Decision Maker, who actually makes the decision on an award of ESA, is not medically qualified.

He makes the decision on an award of ESA, by using any medical evidence provided by the claimant, or their G.P., or other treating HCP, as well as the ESA50, and the ATOS medical report.

The DWP DM has to assess this evidence, with respect to relevant descriptors, and ESA regulations.

Thanks for the reply bro58 I will look there. One other thing you reminded me of. My Doc gave me a med3 to send with the ESA50 whitch I did.It said my problem was incurable and she reconmended I should be in the support group. When I asked the HCP had she read it, she said no, and that it was not sent to her with my ESA50. When I asked if anyone had used the info she said I don't know it's an admin fault and left it there. Surley this is wrong.

Hi col,

A Med 3 certificate is simply a "Fit Note", (Old sick note equivalent).

ATOS do ask that claimants do not send any med certs with their ESA50.

You can however send any other medical evidence, such as reports, extracts from med records, consultant/G.P. letters of support.

Are you sure it was a Med 3 "Fit Note"?.

Med 3's should be sent to the DWP.

If you had a face-to-face assessment for the WCA assessment, ask the JCP office for a copy of forms ESA65 and ESA85. If you did not have a medical assessment prior to being placed in the WRAG, ask for the ESA65 together with form ESA85A.

The information on these forms will tell you why you were allocated to the WRAG, and they will also assist with the pending appeal against your disputed ESA decision.
