Thanks for the info W,

It's just there has been much confusion registered by members in whether they have to attend WFI's, WRA, while appealing.

We have found a JobCentre Plus Leaflet dated August 2011, that states that an appelant does not have to, however we have still not found any such regulations covering this issue.

I couldnt understand the relevance and am so unnerved that I have actually checked the DVLa website for the need to inform and I am pleased that I do not have to as I do not use special controls.Both panel members agreed that I am in a much worse condition than 15 mths ago.I have just filled in another ATOS medical form and am about to go into hospital,will I still be placed in WRAG group even though I will be unable to work until both knees are done?


Are you considering a further appeal against the tribunal's decision to the Upper Tribunal on a point of law?

If so, ask the clerk to the tribunal for a full statement of reasons for the decision and also the record of the proceedings. This will give you an indication as to why you didn't meet the conditions for being placed in the support group, and also whether it is worth pursuing the appeal before the UT?

May I ask if there was any preamble from the panel prior to them asking you that question ? i.e Was the subject re: driving being discussed or is there some information on the ESA form etc that makes mention of driving which led up to that question ?

I was made aware of a DLA tribunal some time back in which they GP panel member contacted the DVLA about the appellant when he ( the GP ) felt they should not be driving. That is highly irregular, although there have been cases when the tribunal have wrote to the appellants surgery stating their concerns.

Does the leaflet have one of those DWP numbers?

Most JobCentre Plus staff are so poorly trained that I doubt whether many would have the confidence to contradict their own literature if they were challenged with it by an appelant.
