esa (cb) ended 30/4/12 awarded esa (ir) was created by abeer
my esa (cb) ended 30/4/12 and i have lodged appeal to be placed in support group on exceptional circumstances. however today i have been awarded esa(ir). My local CAB office told me i dont qualify for esa (ir). Whos right and is it limited to 365 days. Also do i have to attend wrag whilst my appeal for esa (cb) is ongoing. so confusing for me with mental health problems. any advice appreciated.

I'm afraid we can't know whether or not you are entitled to (IR)ESA. this is not subject to any time limit.
Yes you do have to undertake WFI's while awaiting appeal, some adivsers are willing to conduct these on the phone.
Do I have to attend WFI's?

Did the CAB explain why they felt you did not qualify?
ESA(IR) is not time limited.
Yes, you will still be required to attend WFIs while appealing to be placed in the Support Group, however, you can contact your JC+ advisor and see whether they would be willing to defer them until a Decision is made..

Providing the DWP have accurate and up to date information regarding your income, assets and the hours your partner works, then I would assume that the award of ESA(IR) is incorrect.my esa (cb) ended 30/4/12 and i have lodged appeal to be placed in support group on exceptional circumstances. however today i have been awarded esa(ir). My local CAB office told me i dont qualify for esa (ir). Hi
CAB said my partner had too much income.
However i have read all info on your site and it seems I do qualify because my partner has taken early retirement to look after me so therefore he is not working. In addition he is in receipt of IB. Could CAB be basing there judgement on his having a private pension. Shall i go ahead and accept it ............... confusion once again.

I know it is hard for you as you have already received contradictory information from CAB and DWP. However, we cannot give you any definite answers without knowing more about your financial affairs than it would be sensible for you to post on an open forum.
