bamboozled was created by scottishlemonade
the dla doctor was out a couple of weeks ago doing an assessment on me, i recieved a copy of the report the other day there and it says on it was the tribunal service that sent me a copy does this mean it will go back to the tribunal and that it won't go back to DLA to see if they can change their decision.

i already had a date through for my tribunal and on the day i got a phonecall saying that it was cancelled as they needed more medical evidence as they were sending a doctor out to see me and writing to my GP.

It is possible that the DWP, having seen the medical report will find in your favour, but where this happens, they often don't make the Decision until a day or two before the hearing, so I am afraid you may need to wait.

got a letter through the door on tuesday saying it's going to the tribunal but i don't think DLA has even looked at the report from the doctor or GP notes, should i write them a letter to see if they have looked at the report and GP notes?

Based on your previous posts, your case was already with the Tribunal Service, so the latest letter you have received has been sent from the TS not the DWP.

The TS will have sent a copy of the report to the DWP at the same time as they did to you. As you now appear to have a letter with a Tribunal date, it is unlikely that the DWP will re-visit the case until immediately before the hearing. It is possible that at that time they might find in your favour, removing the need for the hearing to take place, but it is more likely, at least statistically, they the case will continue on to the Tribunal hearing and a Decision will be made there.

so is it worth while me sending them a letter saying

Dear sir/madam,
i filled in my renewal forms for DLA at the beginning of the year which i was turned down and my case went to a tribunal in june which they prosponed until they got more medical evidence from GP (medical notes from the past 2 years) and i had the DLA doctor out to see me. i'm wondering if you's have recieved a copy of my medical for the past 2 years and seen a copy of the report from the DLA Doctor and if you haven't would you be willing to have a read of them to see if you can reconsider if i was to send in a copy of them in before the tribunal.

It is entirely upto you whether you wish to send such a letter.

As I said in my previous post, the DWP will have already been provided with a copy of the report by the Tribunal Service and I assume the second report you refer to was already in the evidence pack that the DWP submitted to the Tribunal Service in the first place, so they will have had sight of them.
