Looking for advice on accompanying relative to Tribunal to be placed in Support Group instead of WRAG. Sent Appeal in to DWP with additional information to support the ESA50, e.g. letter from doctor, copy of medication and notes on how relatives life is significantly affected by his medical conditions - reconsideration not successful so DWP have sent appeal to Tribunal. On reading decision from DWP DM there are several things which are incorrect, e.g. relative is called the wrong name 3 times. DM says he is satisfied with HCP medical report based on ESA50 and clinical record but relative was not called for medical and no request has been made for medical records so not sure where his clinical records has come from. He has not been in front of medical board for about 20 years or more when he was told he was not fit for work. Also noticed in HCP medical report that registered nurse has based her report on ESA50 and Med3. Relative has not had to have a Med3 which I assume is sick note for about 20 years. Are these the sort of things I need to present to the Tribunal in support of Appeal?
You need to concentrate on showing how your relative satisfies the Support Group criteria (or special circumstances) and that is where you need to concentrate your efforts.
