LT54 & ESA72 Query please ? was created by angelapinner
Having just spent 8 months waiting for my Appeal on WRAG group decision to be looked at I have received a DWP letter (it did not go to Tribual) containing only this limited information :-
"I can confirm that on review of your appeal evidence, I have changed the decision and you will be awarded the Support Component."
I rang the DWP office asking for more info ie an LT54 (document used on reconsideration) also possibly an ESA72 (whether re-assessment date has been changed) Thank you for all the information the site provides in this respect I really don't know where we would be without your invaluable advice.
Have been advised that "They have no idea what these forms are" despite speaking to three people !

So what do I do now ? I really need info on what part of the Appeal evidence they accepted - there were about 6 different points I raised - in case I need it again in the future but am told that if I write to them asking for further info this could immediately "trigger" another look at my file and I may be sent an ESA 50 form and start it all over again.

Any advise would be very much appreciated. Many thanks.

PS As I am affected by the 365 day ESA CB rule and this decision, presumably, overturns the original WRAG decision does this mean I have not used up any of my 365 days while waiting the 8 months for this to be looked at ?

Congratulations on the revision.

I am afraid the DWP call centre staff can be next to useless, and my general recommendation is to give them one chance and then put it in writing.

There definitely should be an LT54 as this is used to document a revision, we are still unclear as to when, or even if, an ESA72 is issued.

If you want to make the request more formal, the phrase your letter as a Subject Access Request, there is a guide on the following link

If you were put straight into the WRAG from a new ESA claim, or another benefit, then you are correct in thinking that this Decision resets the clock to zero.
