On JSA, moving to ESA was created by Paul's friend
Hi

I hope someone on this Board can help me. I have spoken to the ESA helpline, to new ESA claimants contact number, and also to the Jobseekers Plus in person and each time I speak to someone I am given different information.

My friend whom I have power of attorney for is currently on JSA but we have applied to ESA to start next week.

I completed the ESA1 form and sent it in and we will be sending the "fit" note from the doctor to say he is unfit for work. The doctor is fully supportive of this claim.

I understand that my friend has to come off JSA before they will consider his ESA application and he will do this on the date we asked the ESA to commence (which is also the date the fit note is dated). Is this correct? (I was told by one advisor that they would move him from JSA to ESA and we don't have to do anything but the others I have spoken to have said he has to come off JSA before they will look at his application).

My friend also receive DLA at high care and high mobility which means that he receives the enhanced disability premium and the severe disability premium on his JSA, and housing benefit. However I cannot find out from anywhere what he has to do to receive these premiums on his ESA. Will they automatically add them to his ESA payment, or do we have to put in a claim again. Also, does the housing benefit stop automatically when he comes off JSA or will it continue through to ESA.

He is using a considerable amount of his payment to pay towards his care and no-one is able to tell me whether he will get his premiums automatically or whether we should contact the Council to advise them that he will not be able to afford to pay towards his care.

As far as I am aware you will need to close the JSA claim on the day before the ESA claim is intended to start, the DWP should be able to move his details over to the new claim automatically, which should reduce the time it takes to set up the new ESA claim and should mean that there is no interruption in payment.

The Enhanced Disability Premium and the Severe Disability Premium should be paid automatically, but I would monitor this as the DWP historically; have a habit of not paying it when the claimant is in the Assessment phase, even though they should.

You need to contact the DLA Unit and the Local Authority to inform them of the change of benefit, you can do this by phone but should follow up in writing sent by Recorder Delivery.
