Can going off work sick effect my redundancy pay?

Hi,

I work for the HMRC and I am a temporary employee, my contract ends in March 2014, as they are getting rid of about 500 employees, they have apparently 90 days to find me full time employment in the HMRC or they have to pay me redundancy pay.

I have worked for them for over 2 years it was June 2011 when I started I have passed all of my probation and have never failed quality checks.

I have four questions:

1) I have been stressed for some time with the thought of not having a job, as I have applied for over 300 jobs in two years, 40 of them in the civil service and haven’t had one interview.

I also have been bullied by many of the managers and have had to have countless meetings with the union and the managers to get a fair go at my employment. As I am hard of hearing and they had me in the call centre, but when I complained to say the head sets where to difficult to use, they wouldn’t make the reasonable adjustment for me by giving me a speaker loop system, which the medical company employed by the HMRC, ATOS said was reasonable adjustment for my hearing aids and hearing impairment.

Despite that they didn’t get me the system, even though I was promised it by one manager, they moved me to processing floor, which is mainly typing data into a system.

They then tried to let me go early in January 2014 by cutting my contract, I have only just won the right to have my contract extended till march 2014 today, as I said it was discrimination, as they moved me and one other hard of hearing employee to the processing floor and then cut only our contracts to January 2013 and kept the other 500 workers on the same contract on till March 2014.

I was told this was the case with the contracts being the same by HR.

I am completely stressed and I’m worried if I go of sick as a temporary employee will I loose my redundancy pay when our contracts end in March 2014?

(The contract ending is definitely happening as the head of the HMRC put it in a news bulletin for all staff, although they didn’t inform the union before putting the bulletin out which is in discussions with the PCS union)

2) How does redundancy pay work is it they have 90 days before the end of the contract? I.e. if I finish in March 2014 do they have to get me a job in between the time of January to March 2014, which is around 90 days?

Or is it 90 days from the period of ending employment? I.e. if I go in March 2014 is it likely to be June 2014 when I receive the redundancy pay, which is 90 days from the end of employment?

3) How much is redundancy pay for a temporary worker who has worked in a company for over 2 years who has passed there probation?

(I did a statutory redundancy calculator, for some one my age 32 it about one thousand one hundred pounds, I’m thinking if that’s statutory would it be slightly more with passing probation)

4) If I do go off with stress can I get the full 28 weeks statutory sick leave being a temporary employee, as I have passed all probation and have never failed a quality check?

Not withstanding Gordon's reply, you have certain rights regarding your contract of employment, in regard to redundancy and related matters.

If you are in a Trade Union, then you should seek advice from them.

If not, then the site owners wife is a former barrister, now specialising in Employment Law.
