ESA Help / Advice appreciated. was created by sia7
Hi all
Confused as ever over these ESA forms. I filled in ESA50 "03/11" approximately November 2012 and was placed in the WRAG (both Contribution and Income related). Early December 2012 I asked them to re-assess and was notified in August 2013 that I had been put in the Support Group (no medical whatsoever in both decisions). A few days ago I received ESA "01/13" to complete so I've obviously got to go through the whole stressful scenario once again
Has anyone else been "re-called" after such a short time in the Support Group or is it more to do with the fact that the original WRAG decision (November 2012) meant my 12 months of Contribution is due to end November 2013 (even though I've since been put in the Support Group where I believe the CB/IR is not discontinued)?
I've just read here that I need the ‘Pre-January 2013 changes’ version of this guide if the initial decision on your claim was made before 28th January 2013. Even if you go on to ask for a revision or an appeal you will still be covered by the old rules." - Can someone confirm and explain, in simple terms, what differences are there. I get confused and find it hard to digest information but I'm thinking I'm still under the "Old Rules", is that right?
many thanks.

Apologies Gordon but I'm going to tag onto your query as it is similair to mine.
I have also been put the ESA Support Group last year and have now receieved an ESA50 01/13 to complete. Is this normal?
Thanks you

Nothing on this board constitutes legal advice - always consult a professional about specific problems

As you suggested, revised awards apply from the date of the original Decision not when the revision occurs so you are treated as having been in the Support Group since December 2012.
Your new assessment will be done under the January 2013 changes so you need to review the latest versions of the ESA Claim guides.
I do not think there is a summary of the changes in any of the guides, the primary change is that you can, in principle, no longer score points in the physical section due a mental health problem and vice versa, also there were also changes to the rules surrounding cancer, most of the physical descriptors assume the use of aids and appliances, and finally there are changes to the Exceptional Circumstances Regulation 29 which relates to the WRAG.

All I can say is that it is not unusual.

The backbone of the Welfare Reforms is that everyone in receipt of sickness and disability benefits will be subject to frequent reassessments - even if their condition is lifelong/progressive.

Hi
I am also in the process of re-assessment, I had an SG award of 12 months, which is quite short for an SG award and in July the form materialised again. Frequent re-assessments are part and parcel of life on ESA unfortunately. All you can hope for is that if successful, you get a longer prognosis next time.
