DWP medical proffesional used wrong condition!!

I have just had all my paperwork from tge DWP that they had to submit to the tribunal, going though it I cant believe what I have just seen. I applied for my pip when told to do so by DWP, I have been on high rate care and mobility for 3 years. I filled in the forms sent them off, I didnt get called for an assesment but had a letter stating i could only have standard mobility and no care. Done an MR then awarded enhanced mobility but only 7 points for day living. I put in for an appeal on 7.1.15, DWP havent responded to any Tribunal letters up until now. I have just gone through my file and no wonder I havent got enough points, the DWP medical proffesional has only gone and based my condition on spondylosis and infact My consultant reports and my medical evidence states significant spondylolisthesis!!... they are two completley different conditions. Their reports state moderate pain somedays when infact my medical reports state chronic pain!! We got a point of contact in the tribunal as im having a skype hearing so we will be ringing then Tuesday, how can they make such a mistake, surely it should have been picked up in my MR?

I think it is commonly known as "Incompetency" ! :)

You should point out any obvious discrepancies within the medical report, but it is very important that you also reiterate how and why you score the requisite number of points under the relevant Daily Living Descriptor/s for an award.

The MR would have been carried out by a different DM - but this person would not have any medical training either. I would imagine it is quite easy for the uninformed to make this kind of mistake - but the HCP should not have done so!

Its been a tough 10 months but finally had my skype hearing Monday and had my outcome by first class post yesterday,I have been awarded enhanced mobility and enhanced daily living until 2020. The appeal its self was very difficult and upsetting but with the support of my mum I got through it.

I am glad that the "Skype" Hearing worked out well, as this is a new facility !!

Good for you Suz. Spondylolithesis age 11. Now 60, plus severe scoliosis and kyphosis. HCP really should know the difference. Glad for your outcome, hope mine goes the same way.
