PIP Change of Circumstances Terminal Illness

Hi ravenmiss, so sympathise, our relative gave us Lasting Powers of Attorney [LPAs] last summer when still having mental capacity to do so. By the time the OPG {Office of the Public Guardian] had registered them it was nearly Christmas and she had lost capacity. The solicitor had warned us about the 5/6 month delay but it caused problems because the social worker could not accept they were valid until after a lengthy delay while the date they were given [ie the forms completed and signed] was checked as it does not appear on the final documents.
The reason I have gone into this is to let anyone thinking of doing LPAs know to do so ASAP and not delay themselves, in case they have similar problems.

Thanks Gary, we looked at her bank account today as her PIP was due and instead of her usual amount a figure 3 times that has gone in so it seems that they've actioned something. Still no letter from them though so I'm unsure if/when that's backdated but we may just leave it now.

I will try and ring them when I'm with her tomorrow. She sleeping a lot now though and it would be awful to wake her :(

I couldn't have rang them today if I tried, she was very distressed and making no sense at all bless her she wouldn't let me go from her side. Think we may have to get the district nurses to look at giving her the anticipatory meds soon :(

The OPG is a joke they've had these insane delays for almost 2 years now with it not getting any better. We looked into it and decided against it as she doesn't have that long left. It's disgraceful.

I've sent a letter to the DWP, it's all I can do for now, it has a timeline of events and shows proof that we tried for weeks on end to get a DS1500 issued.

I know some will say it's easy to just ring but it's not that simple. I have my own health issues and can't always tie in call during office hours or wait for ages on hold. I'd rather spend time with her than hanging on hold next to her whilst she demands my attention. If they ignore it then there's not much else I can do.

Thank you. As the DS1500 has now been sent to the DWP I'm unsure how much MacMillan can assist now but I will contact them in future if needed. She's getting night care a few times a week from Marie Curie now thankfully (we had to question a few why this wasn't in place along with not being assigned a MacMillan nurse and someone finally listened) so that gives us a break from caring which was exhausting her boyfriend.

Letter from DWP arrived Saturday: She's been awarded high rate daily living from the start of the month she went into hospital. It's been backdated and received. They state that as she's over state pension age they cannot give her points for mobility which I thought may not be the case for Special Rules cases but hey-ho, least it's all sorted out now.

Thanks everyone for the help I really appreciate it, this situation has been made so damn stressful by the NHS which I find so effing disappointing.

I am so glad that it's at last been sorted out and that she is getting the additional care. I'm sorry that it was too late for a mobility award. Well done for persevering in the most difficult circumstances.
