Hi Clarebear

We do hear from members who have received a text message from DWP informing them that they have received a copy of the assessors report.

When they get this message they can then contact DWP and request a copy of the assessors report called a PA4, if they don't get the message then they should contact DWP after 48 hrs for a copy of the assessors report.

Hi Gary,

Finally after months of badgering I finally discovered from Health Assessment Services that they decided my daughter did not need a face to face assessment, in August 2022. For some strange reason they returned everything to ESA who made a decision on 24th August 2022 & placed her in the LCW &WRA group. ESA say they notified UC. However, according to UC they have no record of anything & even have my daughter placed in the highest work activity group. ESA have sent a letter to me now & have apparently once again sent notification to UC. Today UC have told me they're referring everything to their decision making team to look at what ESA have done & to see if they can make a decision. My daughter has never been in receipt of ESA, they put an initial claim into ESA for her even though I told them she hadn't paid NIC. After 6 days they told me she wasn't eligible & needed to claim UC. I've got copies of messages in her UC journal that state the UC50 has been sent to her on the 18th May 2022.
I literally don't know what to do next. In the meantime my daughter is self harming each time I have to drag her into the jobcentre.
Any advice for what I do next will be gratefully received.

Hi Clarebear

I would contact your MP to see if they can get the the bottom of your issue. If your daughter has never been in receipt of ESA then why would they return the documents to ESA.

ESA not longer exists for new claimants, for claimants who do not have enough NI payments, they would have to claim UC, if they have a disability then they would have to apply for LCWRA and complete a UC50 form, which is identical to the ESA 50 apart from the name.

The LCW & WRA has thrown me as they are the same, one relates to UC and the other relates to legacy benefits. Who ever you spoke to after 6 days was telling you the truth, I would expect your daughter to be sent a UC 50 form which is known as a work capability assessment form.

A question I would ask is does your daughter receive counselling or have a CPN?

Hi Gary,

Thank you. We've provided Fit Notes from the first day of her claim, 20th April 2022.
My daughter was under CAMHS for a long time & had a psychiatrist, counsellor & also had counsellors at the specialist school she attended until last year. Unfortunately, currently she's under the care of our GP who has been her GP since she was 5 & is fabulous with her, but we're waiting for adult services to see her. It just feels so unfair to her that they've let her down at UC through lack of oversight & even now the responses are objectionable & obstructive rather than helpful. Typical of the punitive UC system.
I'll contact my MP today.

Thank you for your post,

I have come across a few claimants who are under CAMHS only to be dropped once they leave school, I have raised this as an issue at numerous disability meetings I attend on line, what good it does I do not know, but I will keep raising the issue, especially for claimants who live in rural areas.

Hi Gary
Well my Tory MP & his team have been fabulous. Responded very quickly, took the case to the area manager of the DWP & yesterday everything was sorted. My daughter was placed in LCWRA group under severe condition definition with no improvement likely. All back pay issued & a call received from a senior manager asking if he could tell my MP everything was resolved. I told him NO. He could investigate exactly what went wrong & give a full explanation to my MP as to why my daughter had been placed under unnecessary stress & trauma & then he could provide details as to what would be done to prevent this happening to other vulnerable people & details of how this information would be fed through to Work & Pensions committee's. I think he regretted calling me. He did admit to me that they use the excuse of people needing to source their own information as to what they're entitled to & should claim as a reason to reject most appeals for backdating even if the DWP has given incorrect information to the client. He admitted it's something that is a no win for every client. I think he was just fed up at that point.
