DLA renewal, turned down really upset

Well I had some great news today, a letter from the DLA, saying they had reconsidered my DLA renewal request, and have awarded me LRC and LRM, which is what I had before, yippee, so no appeal tribunal to go to, thank goodness, what a relief. I think the letter from my GP helped no end.

Even though I am very happy and grateful for this award, I was hoping to get the middle rate care, so that we could try and get carer's allowance, as my husband looks after me 24/7, he took early retirement, to look after me. Do you think I should write to the DLA, and ask for the care rate to be looked at again, or leave well alone.

Any advise gratefully accepted.

Hi Chrissie,

I'm afraid that we cannot advise you whether or not you should ask for your care rate to be looked at again, as we cannot provide individual advice. You need 'face to face' advice from a benefits adviser who will have access to your case files as is explained in the FAQ, just below Forum in the User Menu in the green area on the left hand side of this page.

An adviser will be able to look at your awards of LRM and LRC and hopefully do a 'risk assessment' of how safe your awards are, since if you ask for your LRC to be looked at again, the DWP's Decision Maker has the power to look at both components, as DLA is one benefit. It's not unknown for claimants to ask for a review and lose one or both components altogether.

As this is a recent renewal award, it may be advisable to wait a while before asking for the LRC component to be reviewed. However, that decision has to be yours, preferably after seeking advice from the CAB or other agency that deals with social securitybenefits. Community Legal Advice can provide you with details of advisers in your local area if you CAB cannot assist you.

Hi Pat,

thanks for your reply,I thought that as my award only came today, if I wrote to them straight away, they may have looked at it more favourably, but as I would hate to lose what I already have, I think I will leave well alone. Thanks again. Hope Jim is on the mend, and feeling better, please give him my best wishes.

Hi everyone got a letter back from DLA i have been turned down again and i have not got the will to carry on with my claim its to soul destroying so im giving up thanks for your replies :(

I was also turned down DLA after appealing October last year and I felt like giving up. Give yourself a break and try to relax. I applied again in Jan this year and Im ready for the fight again. At the moment Ive sent in My GL24 for appeal and waiting for their reply. Good luck.

So sorry to hear you have been turned down again,please don't give up, c if someone from CAB can help u,that's what the DWP want, have a think 1st, you have a month to get ur appeal in, don't forget.
