Many thanks for all your help I wonder if you would also think I am correct if i point out that she has only made reference to trapped nerve problem in the spine and that it would be unlikely to cause problems with upper limbs,I agree with this statement but it doesn't apply to me because I dont have or ever had this problem in the spine. My problem is in the neck where the nerves are trapped and damaged and caused a weakness and chronic pain in arms so it does affect upper limbs, so do you think I could pull them up on this as well

Sandra, please don't try to argue that you do not have problems with your spine as this would do you no favours. Instead you need to argue that your problems are in your cervical spine (neck) and therefore causing problems with your upper limbs, rather than in your lumbar spine (back) as the HCP seems to assume.

thanks for that,this why I am so afraid ofcomplaining becaus ei dont want to make things worse

You do not say where you are in the Appeal process.
If you have not yet lodged your appeal then you need to be aware of the following.
How long do I have to appeal?
How to submit an appeal

If you have lodged an appeal, but the DWP have not yet completed the Reconsideration process, then there may be an advantage to your notifying the DWP of the incorrect diagnosis. The standard DWP position is that the medical report is to be accepted verbatim, but it is possible to overturn this view if the report can be shown to have fundamental flaws, making a complaint to ATOS about the report is the first stage to doing this.
Please remember that invalidating the report will not result in you being awarded ESA, it may simply result in a new assessment being required. So you also need to go back over your ESA50 and the medical report with the view of showing that you meet the ESA descriptors that you believe apply to you.
I would strongly recommend that you get face to face advice if possible, if nothing else it may significantly shorten the process.

Thank you,I have appealed but at time I sent it in I had not received the medical report so I was unable ro go into any detail so now i have been through it thoroughly would it be better to send another letter or ring them up and explain the situation now
