Please be aware: this article deals with the DWP seeking new powers which some claimants may find distressing to contemplate. 

As the DWP steers a bill to give it access to 9 million claimants’ bank accounts through parliament, it is already pushing for additional powers of arrest, search and seizure.  In effect, the DWP is aiming to have its own anti-fraud police force and to be able to impose huge fines without going to court.  But should such plans go ahead?

Lessons from recent history
The current Post Office scandal is clear evidence of what happens when such powers are misused and there are some worrying parallels between the behaviour of the Post Office and the DWP, as we noted earlier this month in Post Office Horizon software originally aimed at claimants

And there is no doubt that the DWP are serious about getting these powers. 

In a May 2022 report entitled ‘Fighting Fraud in the Welfare System’ the DWP said that “we plan to create new powers so our officers will be able to undertake arrests and apply to search and seize evidence in criminal investigations, when parliamentary time allows. This will enable them to act in a timely fashion, without always having to rely on police resources.”

And last year we reported on a survey which the DWP claimed proved that the majority of the public want them to have such powers.

The DWP say that these powers will be used against “serious and organised fraud”, but how long would it take them to decide that allegedly fraudulent PIP, ESA or UC claims by individuals constitute “serious” fraud?

It is important to note that in the same May 2022 report the DWP used exactly the same phrase “when parliamentary time allows” in relation to creating legislation that would force third parties, including banks, to hand over data to them. 

The following year those provisions were slipped into a bill going through parliament and they are now at committee stage in the House of Lords. There appears to be no serious attempt to prevent them going through.

 So a DWP police force is a genuine possibility and the same technique of adding the provisions to an existing bill in order to allow it may be used again.

Huge fines
The same document also explains that the DWP want powers that allow them to introduce a new type of “civil penalty”, whereby they can impose very large fines on claimants they suspect of fraud, without needing to meet the burden of proof required in criminal courts or even to actually take the claimant to court. 

The fine will be based on a percentage of the amount the DWP believe, but cannot necessarily prove beyond reasonable doubt, the claimant has been overpaid.  It will be in addition to the claimant having to repay all of the alleged overpayment.

Your experiences
When concrete plans to introduce such powers are produced, it’s vital that claimants and the bodies that represent them are not caught unprepared and without evidence about what the results might be.

Crucially, we need to know whether the DWP is open, transparent, subject to effective scrutiny and has an ethos of abiding by the rules and regulations that govern its conduct

So, we’d like to know if you have always been treated fairly by the DWP or if you have you been left feeling helpless in the face of an organisation that makes rules, but doesn’t necessarily follow them itself?

For example:

  • Have you tried to report a change of circumstances by phone and been unable to get through?
  • Have you reported a change of circumstances in writing and received no acknowledgement?
  • Have you sent the DWP documents by recorded delivery, but they have denied receiving them?
  • Have you been threatened with legal action if you didn’t repay money without it ever being proved that you owed it?
  • Have you been told you must withdraw a claim for a benefit immediately or face prosecution for fraud, even though you know you have done nothing wrong?
  • Have you been interviewed under caution without being able to have anyone with you?
  • Have you been offered a deal by the DWP whereby you have to agree immediately to accept an award of a disability benefit that is lower than you think you should get or have the offer withdrawn and have to go to appeal instead?
  • Have you been treated in any other way that suggests the DWP cannot be counted on to follow rules and regulations and treat claimants fairly?

    The silver lining to this cloud would be that giving the DWP powers of arrest would mean anybody interviewed by them automatically obtains the right to free legal representation whether or not they are arrested.

    Well, where to start. I’ve never been treated fairly by the DWP. I’ve been subject to bullying from a senior member of staff “Alison” who later decided to glare at a passing woman in a burka then glance at me and say “and they won’t let us have Christmas trees up but that’s okay” clearly expecting me to share her outrage. I watched her bully a pregnant woman for filling in a job application in blue ink, she sanctioned her for 4 weeks for this and smiled as she did it. 

    Moving onto disability was challenging enough, but I’ve been told by staff “I’m going to give you another chance to answer that” when I’ve answered questions about my disability they clearly didn’t want to believe. I’ve been cut off on the phone after being told “sorry we’re closed” (they didn’t close for another 20 minutes however and I only needed 2 minutes) the lady on the phone was rude and dismissive and I vowed never to phone again. I’ve sent forms into the DWP that they’ve claimed they never received, including one occasion where I was grilled for not sending in a form, only for them to say “oh look it showed up on the system isn’t that funny” aka - “I didn’t look”. They’ve lied, they’ve hidden things from me, they’ve placed me on two false investigations - there are some nice people working at the DWP but the way the organisation is structured it just doesn’t lend itself to being the kind of environment that caring people will work at, we end up with power hungry people who genuinely seem to enjoy inflicting misery on others, that is my experience of the DWP. Making a complaint about a bullying racist only to be told “well we can take the complaint, but she’s one of our best agents”. Stress that makes me ill. 

    I’m not joking when I say, but I would be treated better by the police if they arrested me on suspicion of murder - the police know that treating people with dignity and respect is how you get them to talk, and yet somehow this respectful approach doesn’t apply to the DWP, who employ the sorts of people that I have nightmares about getting these kinds of powers. Who try their hardest to make the process the punishment from the get go of claiming benefits. 

    If they’re so serious about ending fraud, why do they only send written submissions to tribunals 90% of the time? As if we don’t know the answer to that. 

    The DWP has made an estimate that this will save X-Billion £ - what happens when it fails to meet that target? The net tightens and they make the money from legitimate claimants. It’s difficult to overstate my rage at this, not that they care. 

    So would I feel safe with the DWP militia being given the powers of police? I would laugh at the question if it didn’t fill me with such dread, and that is the answer I don’t even need to give.

    The UK is supposed to be a democracy, but this conservative government repeatedly overstep the mark regarding human rights, which is basically what Brexit was all about - freed from the shackles of the European Court of Human Rights, they are free to make up laws as they please. 
    Not only do they deprive ordinary UK citizens of their rights, but also give themselves (and the rest of the rich) free rein to earn sometimes millions of pounds in various corrupt ways, for which they remain unanswerable.

    It is a disgusting invasion of privacy, ironically performed by a government full of corrupt individuals who need their own bank accounts overturned for public scrutiny.

    It has to be stopped.

    Not had any problems from age 16 had a motability vehicle, in those days there were no ways to receive any payments etc just my little three wheeler motability car then after I married and had a child I was allowed a mini again no monetary benefits.  Since I have got older and my disability has increased my struggles and painful I eventually started receiving payments. The last time I had to apply for PIP and Care component it was so stressful. I knew that I needed to get my money but after reading horror stories and hearing about some losing money and vehicles. I was so stressed couldn’t sleep worrying about having an interview now reading that DWP are wanting to look into bank accounts to find out what moneys are spent and on what.  I was so happy and relieved when I heard that I was awarded the full amount of PIP and wouldn’t lose my vehicle so just have to wait a few years to go through the process again.

    I don't want a random person having access to my bank account numbers. Especially if they can edit. It doesn't makesense what if the money goes in and you just take it out that day. Waste of money and manpower.

    Surely we only have to look at the claims for pip and ESA to know how much dishonesty already exists in claims regarding assessments and the lies surrounding them to know were all I. Serious trouble because what ever you say to them about the lies written on so many of the reports and the fact we still don’t have video evidence set up in assessment centres and the fact that your claim form says different to the answers you so called have in your assessment!! It’s really not rocket science !! We’ve been hammered every which way possible since conservatives came into power, doesn’t matter to them, they pledge to care for the vulnerable, the sick and the disabled but we’re used are scapegoats and this is all no doubt to win votes, no one should be allowed to have police powers unless they’ve been through police training and proper legislative procedures and proper training and handling care of the vulnerable, I can’t see how it can be possible for all this and the employment of so many because surely it costs more than they’ll save

    The DWP are making me pay back a child element that i was entitled too! ive been paying this back for over 6 years now. ive contacted them about it and all they said was “we sent you a letter regarding this” to which i informed them that i never received this letter as it was sent to an old address, i asked for this letter to be resent to my new address which at the time was ALREADY on the system! they said that because i didnt send the letter back in at that time, have now to repay money that i was actually entitled too. ive never been given proof of this just got a snobby, horrible person speaking down to me on the phone like i was nothing. didnt even take into consideration anything i said and then proceeded to raised their voice at me in an angry manner when i asked for proof.

    No they should not get anymore powers as they aren't capable of managing the ones they already have.
    It is obvious that there are few to none Responsible adults running the benefits agency at the moment and not for the past 26 years based on my experience,  you could not make up the nightmare I have experienced with the DWP/Benefits agency and NHS since being having my spine crushed at work in '96, honestly its beyond belief and is still going on.

    It is not about policing or cutting benefit, its about being notified by the bank as they are already if someone has a large amount of savings and claim means tested benefit, or if someone is abroad and claiming as in the country , do you really think they have the recourses  or interested on checking what you are spending your money on
    if you are not in this category then you've nothing to worry about

    It is not just those people making claims that have difficulty with DWP. But i do know someone who after 9 months of denial by DWP had to make an official complaint to get them accept that she did have the correct NiCs to claim contibutions based ESA. I had no such luck making my own complaint regarding missing NICs. Eventually i did manage to speak to someone who was prepared to be helpful. Apparently my complaint had been looked at and marked off as having been dealt with. Yet at no point did i hear anything from them. The complint has been escalated but months have gone by. I am now in touch with legal assistance from a specialist. This nonsense should not be allowed to happen. They are behaving in a manner unfitting to a public service.
    I shall have to fine them 25% of income loss plus a lump sum equal to my own calculation of the pension unpaid !!!.  See how they like that...lol

    They drove me to the brink of suicide and made my Bipolar Disorder go out of control all because I changed address...8 weeks without a penny; I had to involve my doctor and my MP. They put me back into a mental health ward and basically, they just tick boxes. What an awful way to make a living trying to find any tiny way to save a penny assuming that everybody is working the system. After 40 years of working and paying my way until I became unwell wasn't easy for me but the government maybe want to look inward but AAZINGLY MY MP HAD MY BENIFITS REINSTATED WITHIN 7 DAYS (WHAT DOES THAT PROVE)

    Typical tories  creating the DWP to becoming a police state blaming disabled people for fraudulent claims ripping of the money they desperately deserve and have the right to under the Human Rights act,
    It’s okay for them to embezzle billions of tax payers money lining their own pockets?,  Yet let’s blame everyone else as usual with this corrupt government and its departments the DWP being just 1 of them . 
    Banks should refuse to forward bank details of confidential information grounds to the DWP ,  Stand up to this dictatorship that the authorities are forcing on us.

    So like the post office, they police and prosecute, makes it tight to challenge with evidence, and in most cases would lose as they know their system and you don’t. I’m assuming we are talking about say someone says they can’t walk and they were seen walking, and DWP say you are fitter than you stated in a document. I think a court is needed to decide as they have a curtain level of impartiality and hopefully fairness. Then both parties can put their case.

      @Jonathan The problem is that judges are not doctors.  Health conditions can be variable or episodic in nature but most people don't understand that. Obviously your neighbours will only see you out and about on a better day, so they're ignorant of the other side of the story. It would be hard for a nonspecialist jury or panel to assess that.

    The DWP cannot be trusted with those kinds of powers. They often make mistakes which usually cost the claimant not them! They have rules and regulations and case law they are supposed to follow and cannot be trusted to even follow those!. If they can fine people without any checks or balances with a court hearing people won’t even be able to fight it or be entitled to know theor justification of arbitrary decisions. It’s like holding a court hearing behind closed doors with no defence!. Utterly wrong. I also believe it breaches people’s right to a private life. Why should DWP know how every penny is spent! It’s all wrong……..it really concerns me. Most people  are honest, why should their honesty be scrutinised when they have done nothing wrong. If people want to commit fraud they will find a way round it. It’s just invading people’s privacy as far as I can see. It’s fraud concerns now they state. How long before they say, they can see PIP isn’t spent in the correct way and take it away, or say people don’t it all so they can downgrade them! It opens a whole can of disgusting worms!

    DWP already has access to claimants bank accounts! A little known act went through a couple of years ago that permitted them to start looking at accounts back to (I believe) January 2020. In 2022 I received a letter from DWP suggesting I was defrauding the government. I had to provide all bank statements for myself and partner for 2 years, explain every individual expense over £200, and the stress and worry made me feel suicidal (I suffer from depression and anxiety as well as other medical conditions). It turned out that DWP already knew exactly what was in my bank statements, and were aware that, back in 2015 when I started to claim ESA I had omitted to tell DWP about a tiny annual annuity from an old work pension, from a place I worked at for less than 2 years. The money comes in on my birthday each year, for less than £40 for the whole year. I had genuinely forgotten about it when I completed my ESA application, having lost my job (complex reasons, but my post was deleted), so I was not in the frame of mind to do much more than fill in the form and submit it. The result of the DWP's 2022 investigation? They decided to deduct 80p/week off my ESA because of my 'excess income'. No apology tendered for the distress caused. Having lost my entire PIP award the previous January, following a protracted and deeply unsympathetic telephone 'assessment' by ATOS, I was already in despair about DWP (though my PIP was reinstated several months later, and actually enhanced) so this latest development threw me into even deeper despair. I no longer have any trust in the DWP or their agents to treat people fairly, especially vulnerable people. It sticks in my craw that vulnerable, low income people are persecuted for a few pence when real fraudsters - wealthy individuals and big companies who actively avoid tax - are left alone.

      @Jilly Thanks for your insights, Jilly. In my own case, there was the grey area of a disability benefit from abroad that I declared but the DWP didn't originally count it as income. But then they went back over it and categorized it as a pension (which I've been receiving since age 34; strange for them to think it's a retirement pension!) I ended up owing £20,000!

      So who knows whose fault that was. The problem was the bullying way they came after me, at the same time that they'd cut off all my other benefits, as if I suddenly wasn't disabled anymore. They treated me like a criminal and when I collapsed on the floor of the Jobcentre, they saw that as being evasive. They never provided proof of their accusations. The onus was entirely on me to provide evidence of my innocence. 

      With the DWP, you are guilty till proven innocent ; that violates our country's legal ethic. Luckily, our MP intervened after 18 months of their abuse and my benefits were restored.

      @Mrs Deeply-Cynical Knowing what I know ( I'm ex Benefits, now retired, volunteer on a similar social media site to this,  - I'm also disabled on ESA and PIP myself ).

      We COULD get Bank Statements but it needed a court order, these could be obtained but because I was Local Authority, it cost, we hadn't  as much money so had to justify it. Was the "fraud" likely worth the cost ?!   Similarly, we would routinely as for bank statements as and  when, we Reviewed and it's only recently with the advent of UC really it's become less common - hence he mess we're in now ! The number with undeclared savings were coming across has shocked even me and that's only the ones who've contacted us for help knowing they're about to Reviewed. The rest I've been told about by those in the Enhanced Review Teams ( we have one who helps us along with several regular DWP  moonlighting for free !).

      Problem is, you SEEM to be  were on CB ESA like me, we don't provide Bank Statements as we can have as much savings as we like ! So you didn't . However, very have to tell them about Private Pensions. 

      Which brings me to the point of this reply - 

      The rules for CB or New Style ESA are that you deduct 50% of any Private Pension OVER £85/wk. Your's wasn't even £85 A YEAR ?! So, that's not going to be it ( though yes, technically it should  have been declared ). 

      Where is this 80p excess income coming from then  ?? 

      If you HAD Income Based ESA instead or as well, then you'd be declaring Savings and supplying your Bank Statement all along as Savings count towards the Capital limits. You can have Income from Savings Tariff ( £1 per £250 or part thereof from £6,000 upwards ) but that's a MINIMUM of £1 deducted ( not 80p ). 

      I'm baffled frankly ?!
