DLA gave wrong advice for child renewal/adult app

You can try escalating the problem to the Independant Case Examiner

but unless you can show that the law allows for the re-instatement of the DLA you may end as frustrated with the process as you are now. I have had a quick look and can;t find any Case Law in this area

Just an update to anyone who might find themselves in a similiar position.

If my son is awarded PIP it will be backdated to the date the PIP team received noitification from the DLA team that his DLA had expired. In effect he will only lose about 5 days of benefit - not the 7 weeks we thought he would.

It's a shame they didn't make that clear in their correspondence to me or my MP and it was only by chance I asked the question so I am very pleased - assuming he gets awarded PIP!
