I don't think it is black and white, because you would need to show that the panels Decision was fundamentally based on the fact that there was no muscle wastage, but there is certainly the possibility that this is an Error of Law, however, given that the claim was refused you have nothing to lose by pursuing it with the UTT. If you are not already aware, you do not usually receive the ESA Assessment rate while making an appeal to the UTT.

I am afraid that we do not have any templates in regard to an appeal to the UTT as this is not an area that we provide advice for (in detail), but all you need to do is to explain your reasons in a letter, the following fact sheet explain the process in more detail.
