PIP appeal

Thanks bro58 - most reassuring. We shall be challenging the DWP guidance that preparing a meal doesn't include moving things around the kitchen (very much in line with your own guidance, in which you say you disagree with the DWP view). We maintain that someone on two crutches cannot fully perform the task of cooking etc a meal. Watch this space - but if you have anything to add (in addition to your excellent guidance) we'd be interested to know.

In short, we won our appeal! The judge gave an extra point for help getting in/out of shower but, more importantly, an extra 2 points for needing assistance to cook. The latter was key, as it gave the necessary minimum of 8 points for the basic award.

You will recall our case turned on the ability to prepare/cook a meal when the person was on two crutches.

We were on the point of raising the question of DWP guidance about ignoring moving things around the kitchen (as in your own guide) but the judge did not consider it necessary for us to raise that aspect. (In fact, we were firmly, but politely, told to leave matters of the law to him!)

So, thanks to all for the brilliant help provided on this website and hope it might help Susie in her case.
