PIP assessor lied and lost PIP was created by rubydoo
Hi, 2 years after breast cancer , 2 ops ,chemo , radiotherapy lymphodema.,problems with cancer drugs etc,had home assesssment and was given PIP until oct 2017 , However was sent a form to be re assessed in July 2016 , and did this with help from this fantastic website, my condition had not changed , and still having problems..Had to attend ctr..Lady doing assessment seemed fine ,told her everything she wanted to know. took extra evidence from oncologist and consultant ,she just glanced at them and gave them me back, explained still having problems.Just had reply from DWP , have lost all my PIP . Everything i told her ,she has put down the opposite and . .shocked at the lies that she has told. Absolutely gutted , more mad at the lies, and down scoring on things. Even said that i drove to the assessment myself , she didnt even ask me, if she had i would have pointed to my husband parked up waiting for me....... mad

I am really sorry to hear this,

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

I have Lymphodema in my right arm ,and most of the time its bandaged,i have very tight underarm scarring from cancer surgery ,very painful , and avoid using this arm for lifting etc. However assessor reported that i had no trouble to carry ,grasp,handle, lift and pick up and reach for a carrier bag , with no issues ..... i didnt as she failed to see i was using my other arm .......... sorry for the moan still so mad
Hi, on my letter from the DWP telling me that i have been refused the award, there is a short report there ,from the assessor , explaining why she has awarded no or very few points. Do i ask DWP for a more detailed report , and at the same time write to request a Mandatory Reconsideration.........
gosh still mad at the lies , seems that every sentence is a lie or i can shoot down.......when can i have my say . Thank you

I'm sorry you are going through this :(

It will be helpful to see the full assessor's report, you can request this from DWP and it should be with you within 10-14 days.

Please don't delay in getting the MR request submitted, even if you have not received the report by then. You don't have to give much information initially, just say that you don't believe the Decision Maker has appreciated the severity of your problems. Also say that you will be sending in more information when you have had a chance to see the assessor's report.

Just had similar experience as you, had enhanced PIP in 2014, assessed this Spring and all taken off, (paper based assessment)

I have just appealed and won the appeal so don't give up.

My advice would be ask for MR, then chase this up by letter. Most of them come back the same unless there is new evidence to enclose.

Kind thoughts, this isn't pleasant to go through

I have now calmed down a little, and have to address the situation ,

First i need to ask for a copy of the assessors report . By phone and letter?

Also submit a MR request ,by phone and letter ? i could argue some of the details from my refusal letter, on this request , should i do this, or wait until i get the full report back.. thanks
