Successful PIP Appeal DWP right to appeal?

Having appealed and won a PIP assessment last week that was turned down in March ( now enhanced rate and
Mobility has been awarded ) I have hd a letter from DWP saying that they may appeal decision and as a result will NOT pay PIP awarded for atleast a month? Is this normal? I am REALLY disappointed as has been hoping for immediate payment as have been without anything since March. Does anyone have experience of this ?

It is common practice for the DWP to suggest that they are going to appeal the decision, It is, however, very rare that they do so. It just means that you are kept waiting even longer for your claim to be settled.

You could phone the DWP and ask whether they are, in fact, going to appeal the decision (don't know whether you will get a straight answer;) or alternatively you could approach your MP and ask him/her to intercede for you.

I'm sorry you are going through this.

DWP have the same right as you to challenge a decision - that is, they can ask for a Statement of Reasons within 1 month and they then have a further month to decide whether there might be a Error of Law that can be taken to the Upper Tier Tribunal.

What is an Error of Law?

I'm afraid it can take several months for the SAR to be sent out, so you might still have a wait for payment if DWP do go ahead

Yes. This is why we suggest that you don't request one, we don't want to put ideas into DWP's heads!

THanks for your help . I did contact the MP but he just said they had the right to appeal with they wanted to so not much help ! Fingers crossed that they don't appeal .
